Trenton Man Convicted of Aggravated Assault and Weapons Charges in 2022 Shooting

A Trenton man has been found guilty of multiple charges, including aggravated assault and unlawful firearm possession, in connection with a shooting that took place in August 2022.

After a two-week trial, a Mercer County jury convicted Davion S. Smith, 26, on February 5, 2025, of all charges listed in the indictment. 

These include unlawful possession of a handgun, possession of a firearm for an unlawful purpose, aggravated assault, and certain persons not to possess a firearm, according to information released by Mercer County Prosecutor Janetta D. Marbrey.  

The charges stem from an incident on August 13, 2022, when Trenton police responded around 1:30 a.m. to reports of gunfire on the 100 block of Oakland Avenue. 

Officers arriving at the scene spotted a vehicle speeding away. The driver, later identified as Smith, was pulled over, and a search of his car led to the discovery of a defaced .38 caliber revolver.  

Surveillance footage from the area later confirmed Smith had fired a handgun in the direction of another vehicle before fleeing.  

The case was prosecuted by Mercer County Assistant Prosecutors Michael J. Mennuti and Jeffrey C. McElwee Jr., with the trial held before Mercer County Superior Court Judge Darlene J. Pereksta.  

Smith is scheduled to be sentenced on April 4, 2025, and could face up to 30 years in prison.

His eligibility for an extended sentence falls under New Jersey’s “Persistent Offender” statute, which applies to repeat offenders with prior convictions.
