Passaic County Prosecutor Camelia M. Valdes and Passaic Police Chief Luis A. Guzman announce that based upon an investigation by the Passaic Police Department, Rosalba Palma, 37, Leslie Hernandez, 19, Angie Alvarado, 19, and Julio Oliveras, 37, all from Passaic were arrested March 1, 2020, in relation to an investigation that took place the same day.
Police say Ms. Palma is charged with Aggravated Assault on a Law Enforcement Officer, Third Degree; Resisting Arrest, Third Degree; and Obstructing a Governmental Function, Fourth Degree.
Mr. Oliveras is charged with Aggravated Assault on a Law Enforcement Officer (3 counts), Third Degree Resisting Arrest, Third Degree; Obstructing a Governmental Function, Fourth Degree; and Possession of Marijuana (under 50 grams), a Disorderly Persons Offense. Ms. Alvarado is charged with Aggravated Assault on a Law Enforcement Officer (3 Counts), Third Degree; Resisting Arrest, Third Degree; and Obstructing a Governmental Function, Fourth Degree.
Ms. Hernandez is charged with Aggravated Assault on a Law Enforcement Officer (3 Counts), Third Degree; Resisting Arrest, Third Degree; and Obstructing a Governmental Function, Fourth Degree.
Police say on March 1, members of the Passaic Police Department responded to a residence in the area of Vreeland Avenue Passaic on a report of a fight.
Upon arrival officers could hear a loud bang coming from the exterior of the property. Based on the interaction that ensued Ms. Palma, Mr. Oliveras, Ms Alvarado, and Ms. Hernandez were charged.
The sentencing exposure on Third Degree Aggravated Assault is 3-5 years New Jersey State Prison; on Third Degree Resisting Arrest it is 3-5 years New Jersey State Prison; on Fourth Degree Obstructing a Governmental Function it is up to 18 months New Jersey State Prison; and on Possession of Marijuana, under 50 grams, a Disorderly Persons Possession Of Marijuana it is up to 6 months County Jail.
Police say Ms. Palma, Mr. Oliveras, Ms Alvarado, and Ms. Hernandez appeared at Central Judicial Processing Court on March 3, 2020 and all were released on conditions. They are next scheduled to appear in pre-indictment court on March 17, 2020.
A criminal complaint is merely an accusation. Despite this accusation, defendants are presumed innocent unless and until proven guilty beyond a reasonable doubt.
