Authorities announce the arrest of Bernard Pinckney, 28-years-old, of Astoria, New York, who was arrested without incident yesterday, in connection with a shooting incident that took place on July 12, 2017, at 691 Main Avenue in the City of Passaic.
Pinckney is charged with Attempted Murder, first degree; Unlawful Possession of a Weapon, second degree; Possession of a Weapon for an Unlawful Purpose, second degree; Possession of a Prohibited Weapon and Device, fourth degree; Certain Persons not to Possess Weapons, second degree.
The sentencing exposure on attempted murder is 10-20 years New Jersey State Prison with 85% of that term to be served before parole eligibility pursuant to the No Early Release Act, five years parole supervision thereafter; on unlawful possession of a weapon (firearm) it is 5-10 years New Jersey State Prison with a minimum of 3 1⁄2 years before parole eligibility pursuant to the Graves Act; on possession of a weapon (firearm) for an unlawful purpose it is 5-10 years New Jersey State Prison with a minimum of 3 1⁄2 years before parole eligibility pursuant to the Graves Act; on possession of a prohibited weapon and device it is up to 18 months New Jersey State Prison; on certain persons not to possess weapons it is 5-10 years New Jersey State Prison with 5 years of parole ineligibility pursuant to the Graves Act.
According to authorities, on July 12, 2017, at approximately 2:54 a.m., police responded to a shooting incident at 691 Main Avenue, Passaic.
A male victim, who has survived to date, suffered a gunshot wound to the torso and was transported to St. Joseph’s Regional Medical Center in Paterson for treatment. Based on the investigation, Mr. Pinckney was identified as the alleged shooter.
Pinckney, who is presently in custody at the Passaic County Jail, is scheduled to appear before the Honorable John F. Meola, P.J.M.C. in Central Judicial Processing Court – located at 77 New Courthouse, 4th Floor in Paterson - today, July 19, 2017 at 1:30 p.m.
The State intends to file a motion for pretrial detention in this matter that will be heard by a Superior Court Judge at a later date.
A criminal complaint is merely an accusation. Despite this accusation, a defendant is presumed innocent unless and until proven guilty beyond a reasonable doubt.
