Two years from the shooting death of a 12-year-old girl in Paterson a judge today declared a mistrial this afternoon.
For a second time in two days, the jury informed the judge that a verdict could not be reached.
According to authorities, on July 5, 2014, Genesis Rincon was struck by a stray bullet as she rode her scooter near Rose Parks Boulevard.
She was taken to St. Joseph’s Hospital and was kept on life support as Rinco’s family finalized plans to donate her organs. She died hours later.
An investigation into the shooting, lead to charged against Jhymiere Moore and Jeffrey Ellerbee who were accused of firing at a white van but ultimately shot and killed Genesis. Both were charged with murder and criminal weapons possession.
According to officials, a third suspect, Marshae Anthony, was charged with criminal weapons possession after allegedly providing the guns used in the shooting.
The three men returned to the Passaic County Jail until Jan. 13 where an initial conference with Chief Assistant Passaic County Prosecutor Paul DeGroot and the three defense lawyers will take place.
Moore and Ellerbee each faced up to life in prison if convicted in a trial. Anthony could have been sentenced up to 15 years in prison if convicted.
