A 22-year-old Trenton man accused of sexually assaulting a child while intoxicated appeared in court this morning for his bail hearing, according to authorities.
According to the Mercer County Prosecutor's Office, David Baten, 22, of Trenton, was charged with sexually assaulting a 6-year-old girl and giving her genital warts.
During today's appearance, the judge ordered Baten's bail to remain at $3000,000, while an Immigration and Customs Enforcement (ICE) detainer remains in affect for Baten who is in the country illegally, according to prosecutor.
The investigation began when the victim's parents noticed she was bleeding and decide to bring her into the hospital for an evaluation. According to reports, a nurse at the hospital, believed that child had an STD and contacted the Division of Child Protection and Permanency (DCPP), to investigate further.
Further investigation, led police to Baten, who reportedly attempted to sexually assault the victim one night when he came home drunk but didn't. Ultimately, Baten admitted to the sexual assault, but claimed the child initiated the encounter after she allegedly climbed on top of him when he was lying down in bed.
