Passaic County officials announced that on May 31, Mr. John Delacruz, 22, from Paterson, was arrested in connection to the homicide that took place on May 27, in the area of 73 Hospital Plaza in Paterson.
According to the Passaic County Prosecutor's Office, Delacruz was charged with Murder, first degree; Attempted Murder, first degree; two counts of Conspiracy to Commit Murder, first degree; two counts of Possession of a Weapon for an Unlawful Purpose, second degree; and Unlawful Possession of a Weapon, Second degree.
Offcials say, additionally, both Wilfredo Garcia, 20, Paterson, and Modino Garcia, 42, from Paterson, have also been charged with this incident with Murder, first degree; Attempted Murder, first degree; two counts of Conspiracy to Commit Murder, first degree; two counts of Possession of a Weapon for an Unlawful Purpose, second degree; and Unlawful Possession of a Weapon, Second degree; however they remain at large.
Offcials aid, on Wednesday, May 27, at approximately 5:38 p.m., police officers responded to the area of 73 Hospital Plaza in the City of Paterson in response to a report of shots fired.
Upon their arrival, the officers discovered Mr. Brian Olivio, 20, from Paterson, suffering apparent gunshot wounds.
According to police, at the same time, a second victim, Mr. David Torres, 20, from Paterson, walked into the Emergency Room at St. Joseph’s University Medical Center, also suffering from a gunshot wound.
Mr. Olivio succumbed to his wounds and was pronounced deceased, while Mr. Torres was treated and later released police said.
The subsequent investigation revealed that a black sedan being driven by Mr. Delacruz pulled up near the victims who were standing together outside 73 Hospital Plaza, at which time Wilfredo Garcia and Modino Garcia exited the black sedan and attacked the victims by physically assaulting them.
During the attack, the suspects opened fire, striking both of the victims. Immediately after the shooting, Wilfredo Garcia and Modino Garcia got back into the vehicle being driven by Delacruz and they all fled from the scene.
Police said on June 4, 2020, a detention hearing was held for John Delacruz, at which time he was detained, pending the disposition of the charges against him.
Wilfredo Garcia and Modino Garcia are still at large and should be considered armed and dangerous.
