NJ Man Sentenced for Violent Attempted Murder, Gun Possession

Authorities in Atlantic County announced that on April 8, Kevin Davis, 38, of Atlantic City, was sentenced on charges of first-degree attempted murder and second-degree possession of a handgun for an unlawful purpose.

AdUnder the terms of his plea agreement, Davis was sentenced to an aggregate term of 15 years in New Jersey State Prison, subject to 85% of parole ineligibility under the No Early Release Act, officials said.

According to officials, on September 13, 2019, Davis shot a man in the stomach with a handgun and then fled the scene on a bicycle.

The Violent Crimes Unit of the Atlantic City Police Department reviewed surveillance video and was able to identify Davis and the home to which he fled, officials stated. 

Officials said a search warrant was later executed at the location, and Davis was detained after he fled on foot.

Investigators located clothing worn by Davis during the shooting, a large amount of fentanyl, and a loaded handgun, which was determined to be different than the one used in the September 13th shooting, officials say. 

Authorities say he pled guilty on February 20, 2024.

This sentence will run concurrent to two others Davis is presently serving.AdOfficials stated that in March 2023, he was convicted after a jury trial of the charges arising from the search warrant execution, including unlawful possession of a handgun while maintaining a fentanyl production facility.

He was sentenced to an aggregate term of 48 years in New Jersey State Prison with 24 years of parole ineligibility, officials said. 

In May 2023, Davis pled guilty to committing a home invasion in Absecon in October 2019 with the same handgun that he used during the September 13, 2019, shooting, according to officials. 

Officials say Davis was later sentenced to a concurrent term of 10 years in New Jersey State Prison with 8.5 years of parole ineligibility.AdDavis’ two co-defendants on that case, Mark Toulson and Kalim Selby, also pled guilty midtrial to armed robbery and were each sentenced to 10 years in New Jersey State Prison with 8.5 years of parole ineligibility, authorities say. 

Officials said Davis, Toulson, and Selby are currently in New Jersey State Prison.

In each case, Davis was prosecuted by the Gangs, Guns, and Narcotics Unit of the Atlantic County Prosecutor’s Office.
