NJ Ensures Compliance at Halloween Pop-Up Stores, Offers Tips for Safe Shopping

This Halloween season, the New Jersey Division of Consumer Affairs has been working to ensure that pop-up Halloween stores throughout the state follow consumer protection laws.

These inspections are intended to provide a safe shopping experience for New Jersey residents, as temporary stores set up shop for the holiday season.AfHalloween is the second-largest shopping holiday in the U.S., with consumers expected to spend $11.6 billion nationwide on costumes, decorations, and more, according to the National Retail Federation.

Many of these purchases are made at pop-up stores that appear in rented spaces leading up to Halloween.

Attorney General Platkin emphasized that these stores are held to the same standards as permanent retailers, stating, "We expect pop-up stores to abide by the laws requiring fairness and transparency in our marketplace."

The Division’s inspections, which began on September 20, 2024, included checks to ensure clear pricing and transparent return policies.

Investigators found no violations of New Jersey’s Consumer Fraud Act among the stores visited. Of over 1,400 scanned items, only two pricing discrepancies were noted, for which warnings were issued.

Acting Director of the Division of Consumer Affairs, Cari Fais, reassured shoppers: “We invite consumers to shop with confidence this Halloween season knowing we’re looking out for their financial interests.”

Fais also cautioned about the temporary nature of these stores, advising shoppers to be mindful of limited opportunities for returns and refunds.

Tips for Safe Shopping at Halloween Pop-Up Stores:

- Ask about store duration:  Inquire how long the store will occupy its space. If the answer is unclear, consider it a warning sign.

- Get contact details: Ask how to reach the store after it closes, such as through a website or alternate address.

- Understand return policies: Clarify what items can be returned, especially after October 31, and whether you’ll receive a refund or store credit.

-Inspect purchases: Check costumes thoroughly before leaving the store to avoid mix-ups.

-Keep receipts and use credit cards: This allows for disputes if purchases don't meet expectations.

-Choose established stores: Opt for stores that have a history of returning each year.AdThese measures and tips aim to ensure a hassle-free shopping experience for those preparing for a spooktacular Halloween in New Jersey.
