Man Charged With Attempted Murder of Toms River Officer, Indicted

A 33-year-old New York man charged with attempted murder of a Toms River officer has been indicted.

According to court documents, the indictment charged Giomar Diaz with attempted murder, aggravated assault, eluding police and aggravated assault while attempting to elude police.

These charges stem from an incident on December 8, 2015 in which the Diaz dragged Toms River police Cpl. Daniel Brennan with his Honda in a state Motor Vehicle Commission office parking lot as he was fleeing the scene of an investigation.

Diaz, whose last listed address was East 172 Street, Bronx New York, remains in the Ocean County Jail on $500,000 bail. There is also Diaz a no bail detainer from the US Immigration and Customs Enforcement Division, since it appears he has been living in the United States illegally. According to records, Diaz was previously detained and deported to the Dominican Republic on criminal charges, allegedly in connection to weapon and drug charges.

Charges were also filed against Alvin A. Hernandez Almanzar, 28, of Camden. He was charged with hindering the apprehension of Diaz, revoked driving, and having an expired driver’s license. These charges arise as a result of him picking Diaz up after the vehicle used to assault Officer Brennan was abandoned. Bail has not yet been set for Hernandez -Almanzar.

Diaz was initially detained by Officer Daniel Brennan as well as Motor Vehicle Commission Investigators as a suspect in a document fraud. Diaz was attempting to use a false identity and documents at the MVC in an attempt to gain additional government documents not in his real name.

Diaz if sentenced could get a maximum of 20 years in prison. Hernandez-Almanzar is facing up to five years in prison.

Both men will be arraigned in the upcoming weeks.
