A state grand jury has decided not to press criminal charges concerning the death of Raul L. DeJesus, 43, of Newark, after its recent session.
On January 5, 2023, DeJesus, involved in a homicide investigation, suffered a medical episode and died after being pursued and arrested by Newark police officers. The incident, recorded on video, was thoroughly investigated by the Office of Public Integrity and Accountability (OPIA), adhering to the Independent Prosecutor Directive of 2019.
The comprehensive investigation included witness interviews, analysis of surveillance and body-worn camera footage, and autopsy results, which concluded DeJesus's death was due to coronary artery disease with acute methamphetamine toxicity.
This evidence was presented to the state grand jury, which, after considering the case on January 22, 2024, elected not to file charges against Officers Alberto Vera and Nicholas Miller of the Newark Police Department.
The pursuit of DeJesus on January 5 was initiated by Officer Vera after spotting him exiting a vehicle linked to a December 10 homicide in Paterson.
A foot chase ensued, ending with the arrest of DeJesus on an embankment along Route 280.The officers followed protocol to ensure DeJesus's safety, rendering aid when he appeared lethargic and had difficulty breathing. Despite EMS treatment and hospitalization, DeJesus was pronounced deceased.
The Attorney General’s Office mandates that all deaths occurring during police encounters or in custody are investigated and presented to a grand jury.
The OPIA's review ensures adherence to established policies and procedures, with continuous monitoring of any subsequent administrative review.
The Independent Prosecutor Directive, guiding these investigations, ensures transparency and accountability in such critical incidents.
