Morris County Prosecutor Fredric M. Knapp and Chatham Borough Chief of Police Philip Crosson announce the indictment of Jerzy Michalak, 54-years-old, former property manager and superintendent for Volker & Apgar Colonial Manor, Inc., an apartment complex located on Main Street in the Borough of Chatham. Between January 5, 2012 and July 2, 2014, Jerzy Michalak allegedly rented out apartments within the Volker & Apgar Colonial Manor Apartment Complex while leading the corporation to believe that the apartments were vacant. Michalak purportedly collected $81,760 in rent payments and security deposits from 17 tenants via check and cash payments and thereafter deposited the money into his personal bank account. Michalak is alleged to have spent the money on personal expenses. The investigation, conducted by Chatham Borough Police Detective Joseph Crecca with assistance from Morris County Prosecutor’s Office Agent John Jespersen, also revealed that the defendant allegedly stole approximately $15,000 in cash to include lottery winnings belonging to one of the owners of the apartment complex. It is further alleged in the indictment that when the defendant was confronted by one of the owners of the business, he fraudulently used the business’ Visa credit card to purchase a one way ticket to Poland. Mr. Michalak has not been seen in the United States since he left for Poland on August 11, 2014. Defendant was indicted by the Morris County Grand Jury on one count of Second Degree Theft by Failure to Make the Required Disposition of Entrusted Property, pursuant to N.J.S.A. 2C:20-9; one count of Third Degree, Misapplication of Entrusted Property, pursuant to N.J.S.A. 2C:21-15; one count of Third Degree Theft by Unlawful Taking, pursuant to N.J.S.A. 2C:20-3(a) and one count of Third Degree Fraudulent Use of a Credit Card, pursuant to N.J.S.A. 2C:21-6h.
