A former Irvington man's appeal, stating that he mistook a 13-year-old boy with someone else when he fired shots, was rejected by appellate panel.
Monday, the appellate panel rejected James Johnson's numerous arguments, to overturn his 2009 conviction for the killing of Justin Grisham.
According to reports, on June 26, Johnson was walking on University Place in Irvington with other men when Johnson fired a shot to the back of Grisham's neck, because Johnson claimed he mistook the teenager with Farad Williams.
It was later determined that the shooting was a result of a feud between Patia Houston (among the men walking with Johnson) and Farad Williams, according to authorities.
He will be eligible for parole in July 2039.
