Edison Man Sentenced in Drug-Related Death

Middlesex County Prosecutor Andrew C. Carey announced today that a 24-year old man from Edison has been sentenced to serve 8 years in a New Jersey state prison for providing drugs that caused the death of a 23-year old township man.

 

According to authorities, Emile “Oatmeal” Constable Jr., was sentenced today in New Brunswick by Superior Court Judge Pedro Jimenez Jr., for strict liability death by providing the drugs that killed a 23-year old Edison man on February 24, 2016.

 

Officials said the 8-year prison term is subject to the No Early Release Act. As such, the defendant will have to serve 85 percent of his prison term before becoming eligible for parole.

 

In addition, Constable was sentenced to a 3-year prison term for possession of heroin with intent to sell, which is to run concurrent to the 8-year prison sentence.

 

Despite the defendant showing up late for court today, and over the objection of the assistant prosecutor, the defendant was allowed to remain free until June 8 when he will begin his term of incarceration.

 

Constable pleaded guilty on January 23, 2018 to one count of first degree strict liability for drug induced death for providing the combination of heroin and fentanyl, which killed a 23-year old Edison man. He also pleaded guilty to one count of third degree possession with intent to distribute, on February 25, 2016, a controlled dangerous substance, to wit a combination of heroin and fentanyl.

 

An investigation by Sgt. Theodore Hamer of the Edison Police Department and Detective David Abromaitis of the Middlesex County Prosecutor’s Office determined that the defendant sold 10 bags of drugs to the decedent.

The victim subsequently died on February 24, 2016 after ingesting the combination of fentanyl and heroin.
