Boyfriend Admits Killing Girlfriend in Fatal Motorcycle Crash

Middlesex County Prosecutor Andrew C. Carey announced that a man from Piscataway has pleaded guilty in causing the death of his 28-year old passenger in South Plainfield on July 4, 2018.

 

According to authorities, Ruddy Custodio, 30, of Piscataway, the operator of the motorcycle, pleaded guilty today to vehicular homicide, driving while having a suspended license, and driving while impaired by drugs.

 

Under a plea agreement reached with Middlesex County Assistant Prosecutor Keith Abrams, Custodio will be sentenced to a prison term of 8 years for causing the crash that killed Jessica Montes, 28, of Piscataway. This term is subject to the No Early Release Act. As such, the defendant will have to serve 85 percent of his prison term before becoming eligible for parole.

 

Officials say the defendant was charged following an investigation by Lieutenant David DeLair of the South Plainfield Police Department and Detective Donald Heck of the Middlesex County Prosecutor’s Office.

 

The investigation determined that Custodio was driving his 2016 BMW motorcycle on New Brunswick Avenue near Carlton Avenue, lost control and hit a curb. The passenger was ejected from the motorcycle driven by Custodio. Montes was taken to Robert Wood Johnson University Hospital and pronounced dead from the injuries she sustained in the crash.

 

According to authorities, Custodio is scheduled to be sentenced in New Brunswick by Superior Court Judge Diane Pincus on January 2, 2019.
