An Atlantic City man pled guilty this week to 1st degree aggravated sexual assault in connection with the luring and sexual assault of a 7-year-old girl last year, Atlantic County Prosecutor Jim McClain announced.
On May 30, 2014, in response to a 9-1-1 call, Atlantic City Police officers responded to North Harrisburg Avenue, Atlantic City, for a report of the sexual assault of a child. The caller had reported to Atlantic City Police communications having entered into a room and discovering the sexual assault of the 7-year-old child in-progress, reported that the attacker was a person known to the family, and that he had fled the scene on foot upon being discovered.
Shortly after, police located Victoriano Sevilla, 60, of the 400 block of North Harrisburg Avenue, Atlantic City, at the intersection of Harrisburg and Porter Avenues, and arrested him without incident.
Sevilla was charged with aggravated sexual assault and with luring a child into the back door of his apartment with the purpose to commit aggravated sexual assault.
He was lodged in the Atlantic County Justice Facility on $300,000 full cash bail set by Atlantic County Superior Court Judge Nancy L. Ridgeway, where he has remained.
On December 3, 2014, an Atlantic County Grand Jury indicted Sevilla on five criminal counts:
Aggravated Sexual Assault—a crime of the 1st degree,
Luring, or Enticing a Child—a 2nd degree crime,
Sexual Assault—a 2nd degree crime,
Endangering the Welfare of a Child—a 3rd degree crime, and
Obstructing Administration of Law—a 4th degree crime.
On Monday, December 7, 2015, Sevilla pled guilty to Aggravated Sexual Assault before Atlantic County Superior Court Judge Michael J. Blee.
Pursuant to a negotiated plea agreement, and in accordance with the provisions of Jessica’s Law—passed by the Senate and General Assembly of the State of New Jersey on May 14, 2014—Sevilla must serve a 20 year sentence of incarceration in New Jersey State Prison without becoming eligible for parole until he has served 18 years.
Upon release from prison, Sevilla will be subject to Megan’s Law registration and parole supervision for life.
Sevilla is scheduled for sentencing by Judge Blee on January 22, 2016. Assistant Prosecutor Kathleen Robinson represents the State in the case.
